Vacation Rental Agreement
In lieu of signatures, payment by guest, or guest’s agent, of any amount towards the rental of property represented by Journey West constitutes acceptance of this Rental Agreement. Guest hereby acknowledges they are at least 25 years of age. All guests staying at or visiting the property are jointly and severally liable under this Agreement.
Availability; Journey West takes every effort to ensure that you will get the exact property you request. If, in the unlikely event circumstances beyond our control prevent us from honoring your request we may (a) cancel the reservation and refund all monies paid, or (b) transfer your reservation to a comparable or superior unit managed by Journey West. Our maximum liability for damages incurred as a result of the unavailability of the property shall be limited to the total amount of fees paid under this Agreement.
Payments; An initial deposit of an amount equal to at least 50% of the rental amount plus applicable taxes, processing fees, cleaning fees and damage insurance (or damage deposit), shall be due at time of booking. The final balance is due in full no later than 30 days prior to the arrival date. If not received this reservation shall be cancelled. All payments become property of, for the exclusive use of, Journey West. You hereby authorize Journey West to charge the credit card used for any initial payment for any additional monies due under this Agreement.
Cancellation; Cancellations received one week or more before the arrival date will receive a 50% refund less a processing fee. You are responsible for all nights reserved regardless of the day of arrival or departure.
Travel Insurance; Journey West offers travel insurance, for an additional fee, which can provide refunds for cancelled travel plans. Please visit the “Plan your Trip” dropdown tab on our website, at journeywestcolorado.com, if you would like to learn more.
Parking; You will be provided with a parking pass and must obey parking rules set by the governing body of the property you are a guest at. Failure to display your pass and follow these guidelines may result in your car being towed.
Occupancy; Exceeding the occupancy as advertised for this property will result in a $500 fine, eviction, or both.
Check-In time is 4 pm MST. Check-out time is 10 am MST. It is important that you honor check-out times as the cleaning crew has a tight schedule in preparing for the next guests. If you have not checked out by 10 am there will be an additional charge of one full day’s rate (unless other arrangements have been made in advance).
Damages; You are responsible for any damage or unreasonable wear and tear to the vacation rental unit, including all contents, that occur during your stay. Please notify us of any existing damage to the unit immediately upon arrival to avoid liability. No waxing of skis or snowboards is allowed on the premises! Damages, excessive quantities of missing amenities (soaps, shampoo etc.), missing linens or other missing contents will be charged to your credit card.
Lost Items; Journey West is not responsible for loss of money or valuables of any kind. Items left behind are your sole responsibility. If something is left behind, please contact us and we will search for it. If found, we will gladly return it for the cost of postage plus a $15 surcharge. Lost keys to the rental unit are subject to a $75 replacement fee.
Departure Procedures; A small list of departure procedures will be provided and must be completed to avoid additional charges (i.e. put keys back in lock box, make sure all doors and windows are locked, dishes washed, trash removed, all used towels placed in the shower/tub etc.). You may be charged $39.00/ hr. to correct any uncompleted items or if you leave the condo dirtier than is normal or reasonable.
Start-up Supplies; We provide you with initial supplies to get started (Toilet paper etc.) but once used we do not restock. We are not a hotel or B&B and expect you will provide for your needs (as you do food).
Entry & Inspection; Journey West, it’s contractors and agents shall have the right to enter the property at any time in case of emergency, or to make repairs.
Laws, Rules & Regulations; You agree to comply with all statutes, ordinances, and requirements of all local, state and federal authorities. No parties, events or loud music are allowed inside the property or on the deck. No smoking (of any kind) is allowed inside the premises or outside on patios/decks. No pets are allowed at any time. A $500.00 fine will immediately be charged for violations to any laws, rules and regulations. Second violations will result in eviction with no refund. If legal action is necessary, you agree to be responsible for all legal fees for both yourself and Journey West.
Assumed Risk; This property is in a high alpine environment and is subject to low oxygen, heavy snow, freezing and slippery conditions. Use of the property, as well as hot tubs, swimming pools or other amenities, are at your own risk.
Construction Activities/Actions of others; Journey West has no control over possible construction activities or any actions of others which may impact your stay. We will of course notify you at the time of booking of any events or possible issues we are aware of. Beyond that we cannot make any representations or warranties as to anything else which may occur.
Indemnification and Waiver; You agree to hold harmless the property owner and Journey West, from any and all liability for costs, expenses, claims, disputes, litigation, judgements and attorney fees resulting from loss, damage or injury to you, your guests or licensees, or their personal property arising out of your, your guests, their invitees and licensees occupancy or use of the property, except for injury or damage caused by the gross negligence of the Released Parties. This waiver is intended to be a full and complete waiver and release of the Released Parties from any and all present and future claims.
Insurance; You acknowledge that the above Released Parties’ insurance does not cover you, your guests and their invitee’s personal property, including vehicles, against loss or damage due to; fire, theft, vandalism, rain, snow, water, criminal or negligent acts of others, or any other cause.
Attorney Fees; In any action or proceeding involving a dispute arising out of this Agreement, the prevailing party will be entitled to reasonable attorney fees and costs incurred in enforcing this Agreement.
Entire Agreement; The foregoing constitutes the entire Agreement between the Parties.
Notices; All notices to be delivered under this Agreement must be in writing and may be delivered in electronic form via email.
